The Wisconsin NHPA § 106 Submittal Process

Does Your Project Affect Properties Within the Reservation Boundaries of a Native American Nation with a Formal Tribal Historic Preservation Officer?

Is any part of your proposed undertaking located within the reservation boundaries of a Native American Nation or Tribe that has a federally designated Tribal Historic Preservation Officer (THPO)? In Wisconsin, currently the following five Native American Tribes formally have THPO designation:

  1. Bad River Band of Lake Superior Chippewa Indians
  2. The Lac Courte Orielles Band of Lake Superior Chippewa Indians
  3. The Lac du Flambeau Band of Lake Superior Chippewa Indians
  4. The Red Cliff Band of Lake Superior Chippewa Indians
  5. Forest County Potawatomi
  6. The Ho-Chunk Nation
  7. The Menominee Indian Tribe of Wisconsin,
  8. The Oneida Nation of Wisconsin
  9. Stockbridge-Munsee Community Band of Mohican Indians
  10. Sokaogon Chippewa Community (Mole Lake Band of Lake Superior Chippewa)
  11. St. Croix Band of Lake Superior Chippewa

If your undertaking will occur solely within the reservation boundaries of a Native American Nation or Tribe that has formal THPO status, then you must submit the project materials directly to the THPO for the § 106 review. The Wisconsin SHPO does not have review or other consultative authority in these cases.

If your project is located within the reservation boundaries of a Native American Nation or Tribe that has formal THPO status and is also outside of the reservation boundaries, then you must submit project materials to both the THPO and the SHPO for review.
